Notice, pursuant to ORC 5301.332, is hereby given to the following: Callander and Kimbrell, whose last known address is P.O. Box C, Worthington, Ohio 43085, and to his successors, heirs and assigns, who may hold an interest in a certain oil, gas and mineral lease described as follows (the “Lease”):

An Oil and Gas Lease from Edward E. and Charlene Ross and David N. and Wanda L. Ross, to Callander and Kimbrel, consisting of 534 acres, dated February 5, 1974, filed for record February 25, 1974 and recorded in Volume 86, Page 185 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Sections 5 and 6, Range 8, Township of Bedford, Coshocton County, Ohio, bounded on the North by lands of Shearn, Gilmore, Darr, East by lands of Gilmore, Hains, Barrick, C. Haines, South by lands of Barrick, Groves, and West by lands of J. Groves, Trull, McCurdy, Shearn (the “Lease Property”).

ETM Holdings, LLC acquired a portion of the Leased Property by deeds recorded at Official Records Volume 668, Page 184, and Official Records Volume 668, Page 136 of the Records of Coshocton County, Ohio.

The Lease has expired by its terms because neither oil nor gas or their constituents is being found on the Leased Property in paying quantities and the Leased Property is not being operated in the search for oil or gas.

Please be advised that because of the failure and breach of the Lease, ETM Holdings, LLC, the current fee simple owner of a portion of the Leased Property, intends to file for record an affidavit of forfeiture pursuant to ORC 5301.332 with the County Recorder of Coshocton County, Ohio, if you do not release the Lease of record within thirty (30) days from the date of publication of this Notice.
