Legal Notice

Notice, pursuant to ORC 5301.332, is hereby given to the following: W.D. Black, whose last known address is unknown, and to his successors, heirs and assigns, who may hold an interest in certain oil, gas and mineral leases described as follows (collectively the “Leases”):

An Oil and Gas Lease from J.H. Ralston and Jennie E. Ralston, his wife, to W.D. Black, consisting of 134 acres, dated March 2, 1911, filed for record April 7, 1911 and recorded in Volume 8, Page 532 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Bedford Township, Coshocton County, Ohio, bounded on the North by lands of Melvin Barrett and Frank Keifer, East by lands of Isaac Barrett, South by lands of W.L. Freese, J.H. Harper and Zack Bush, and West by lands of Milton Hoffstatter;

An Oil and Gas Lease from R.H. McFadden, to W.D. Black, consisting of 128 acres, dated February 25, 1911, filed for record April 7, 1911 and recorded in Volume 8, Page 537 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Bedford Township, Coshocton County, Ohio, bounded on the North by lands of K. Ralston, East by lands of Orange Guthrie, South by lands of O.D. Almack, and West by lands of Scott Barrett;

An Oil and Gas Lease from J.H. Ralston and Jennie E. Ralston, his wife, to W.D. Black, consisting of 80 acres, dated March 2, 1911, filed for record April 7, 1911 and recorded in Volume 8, Page 539 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Bedford Township, Coshocton County, Ohio, bounded on the North by lands of Zack Bush and Wilson Nash, East by lands of Jacob Adams and Thos Underwood, South by lands of Jas Hughes, and West by lands of Zack Bush;

An Oil and Gas Lease from Zack Bush and Margaret Bush, his wife, to W.D. Black, consisting of 368 acres, dated February 27, 1911, filed for record April 7, 1911 and recorded in Volume 8, Page 546 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Bedford Township, Coshocton County, Ohio, bounded on the North by lands of Milton Hofstatter, Noah Barret, and John Harper, East by lands of Wilis Nash and J.H. Ralston, South by lands of A.C. Ralston, and West by lands of Bedford, Perry Township line;

An Oil and Gas Lease from Zack Bush and Margaret Bush, his wife, to W.D. Black, consisting of 28 acres, dated February 27, 1911, filed for record April 7, 1911 and recorded in Volume 8, Page 550 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Bedford Township, Coshocton County, Ohio, bounded on the North by lands of John C. Hawthorn and Fred Spang, East by lands of John C. Hawthorn, South by lands of Jacob Adams, and West by lands of W.L. Freese (the above-described property collectively referred to as the “Leased Property”).

ETM Holdings, LLC acquired a portion of the Leased Property by deeds recorded at Official Records Volume 684, Page 332 and Volume 668, Page 184 of the Records of Coshocton County, Ohio.

The Lease has expired by its terms because neither oil nor gas or their constituents is being found on the Leased Property in paying quantities and the Leased Property is not being operated in the search for oil or gas.

Please be advised that because of the failure and breach of the Lease, ETM Holdings, LLC, the current fee simple owner of a portion of the Leased Property, intends to file for record an affidavit of forfeiture pursuant to ORC 5301.332 with the County Recorder of Coshocton County, Ohio, if you do not release the Lease of record within thirty (30) days from the date of publication of this Notice.
