Notice, pursuant to ORC 5301.332, is hereby given to the following: Richard Shultz, whose last known address is 305 Pioneer Trail, Aurora, Ohio 44202, North Coast Energy, whose last known address is 5311 Northfield Road, Bedford Heights, Ohio 44116, Capital Oil and Gas, Inc., whose last known address is 856 Ohltown Road, Austintown, Ohio 44515, Keith C. Ruffner, whose last known address is 3009 Oakridge Road, Cuyahoga Falls, Ohio 44224, John C. Shannon, whose last known address is 3055 Kingston Circle, Silverlake, Ohio 44224, Richard Wissler, whose last known address is 35 Ingleside Drive, Hudson, Ohio 44236, Brown Petroleum Corporation, whose last known address is 1026 Cookson Avenue, New Philadelphia, Ohio 44663, Cardinal Ridge Development, Inc., whose last known address is 1349 S Huron, Ypsilanti, MI 48197, Robert E. Hogg, whose last known address is 5353 Belmont Ave., Youngstown, Ohio 44505, and to their successors, heirs and assigns, who may hold an interest in a certain oil, gas and mineral lease described as follows (the “Lease”):

An Oil and Gas Lease from Edward E. and Charlene Ross, to Rowley & Brown Petroleum Corporation, consisting of 144.85 and 55.5 acres, dated December 31, 1979, filed for record January 2, 1980 and recorded in Volume 97, Page 835 of the Lease Records of Coshocton County, Ohio. The premises described as being situated in Section 6 and 15, Township of Bedford, Coshocton County, Ohio, bounded on the North by lands of R&D Ross, J. Shern, East by lands of Co. Rd. 60, South by lands of B. Groves, and West by lands of B. Groves, R&D Ross, J. Shern (the “Leased Property”).

ETM Holdings, LLC acquired a portion of the Leased Property by deed recorded at Official Records Volume 668, Page 184 of the Records of Coshocton County, Ohio.

The Lease has expired by its terms because neither oil nor gas or their constituents is being found on the Leased Property in paying quantities and the Leased Property is not being operated in the search for oil or gas.

Please be advised that because of the failure and breach of the Lease, ETM Holdings, LLC, the current fee simple owner of a portion of the Leased Property, intends to file for record an affidavit of forfeiture pursuant to ORC 5301.332 with the County Recorder of Coshocton County, Ohio, if you do not release the Lease of record within thirty (30) days from the date of publication of this Notice.
