NOTICE OF INTENT TO FILE AFFIDAVIT OF
FORFEITURE OF OIL AND GAS LEASES
OHIO REV. CODE 5301.332

TO: Independent Oil Investors, whose last known address was: PO Box 468 Lakeside, Michigan 49116 and W.E. Shrider & Co., whose last known address was: 67 N. 2nd St. Newark, Ohio 43055

1. The undersigned, James P. Mitchell says that he is the current owner of 61.411 acres of real property situated in the Township of Perry, County of Coshocton and State of Ohio, and which is known as being Permanent Parcel Number 031-00000119-00 and which is more fully described in the deeds recorded and incorporated by reference as if fully rewritten herein.

2. The aforesaid land was made subject to the following oil and gas leases:

a. Oil and Gas Lease from Alberta Goeb, single, to W.G. Dugan, PO Box 65, Bladensburg, Ohio 43005, dated January 10, 1977 and recorded in Volume 92, Page 818, Coshocton County Lease Records covering 61.13 acres in Perry Township; Described in the lease as bounded on the North by Reese, bounded on the East by Donaker, bounded on the South by Ramsey, and bounded on the West by Dawson.

b. Oil and Gas Lease from Alberta Goeb, single, to W.G. Dugan, PO Box 65, Bladensburg, Ohio 43005, dated January 10, 1978 and recorded in Volume 94, Page 14, Coshocton County Lease Records covering 61 acres in Perry Township; Described in the lease as bounded on the North by Emmett Reese and Dawson, bounded on the East by lands of Eucil R. and Ruth Donaker, bounded on the South by Donald L. and Kathryn D. Ramsey, and bounded on the West by Joseph E. and Virginia Dawson.

c. Oil and Gas Lease from Alberta Goeb, single, to W.E. Shrider & Co., 165 Oakwood Ave. Newark, Ohio 43055 dated January 10, 1975 and recorded in Volume 87, Page 961, Coshocton County Lease Records covering 61.13 Acres in Perry Township; Described in the lease as bounded on the North by Reese, bounded on the East by Donaker, bounded on the South by Ramsey, and bounded on the West by Dawson.

3. James P. Mitchell says that the leases referred to above have been abandoned by the lessees, their heirs, successors and assigns; that there are no producing wells, drilling oil and gas well or wells on the premises covered by said leases or any premises pooled with said leases; that all of the rights under said leases and all assignments thereof, have been forfeited and are void because the terms thereof have expired and no production is being obtained from the premises and no rents or royalties accruing under or by virtue of said leases have been paid.

4. James P. Mitchell further states that by reason of the non-compliance with the terms of said leases by the lessees and their assigns, James P. Mitchell hereby declares the above mentioned leases to by forfeited and will not, by acceptance of rentals or royalties, or in any other manner, recognize the same as a valid or existing leases.

5. Pursuant to Ohio Revised Code 5301.332, the undersigned hereby demands that, if the lessee or the lessee’s successors or assigns claim that any of the above leases are in full force and effect, the lessee or the lessee’s successors or assigns shall, within sixty (60) days after the mailing or publication of this notice of the lessor’s intention to declare the leases forfeited, notify the person who filed the affidavit of forfeiture of the claim, and file for record an affidavit with the office of the county in which the land is situated stating that the lease has not been forfeited and that the lessee or the lessee’s successors or assigns still claim that the lease is in full force and effect.
